    Divorce Scam - Quit Claim Deed

    Wife convinced husband to quit claim deed to home to her name in order to prevent potential financial liability due to his heavy-equipment operation. Once home quit claimed to wife, wife filed for divorce and refused to return equity in home to husband. Husband is now left without home.

    Lawyers helpless as husband willingly signed quit claim deed.

    Is there any alternative husband may have in this situation to recover lost equity?

    Your friend may want to consult another attorney for a "second opinion", but in my experience, there is very little that can be done at this point. You would probably be better off talking to a local magistrate to see if there is possibly some civil action he can take if he can make a case for fraud on the part of his ex-wife.

    Mary,

    Double check with an attorney, but depending on the state in which they reside, there may be some community property provisions that would help the husband, but most likely, the quit claim deed would hold up. This is a case of know what you are signing and the potential risks associated with it. Once the quit claim is recorded (make sure it was recorded, otherwise it is a worthless piece of paper), it's a completely legal and binding transaction releasing any and all interest in the real property. But, do double check with a good real estate attorney.
