    Herbalife Drilled By The FTC

    Herbalife did not get shut down by the FTC but they were slapped with paying 200 million and they have many many restrictive injunctions that are similar to what Vemma received. The next 10 months will be interesting indeed.

    The FTC will not require Herbalife to sell to actual customers who are not Herbalife distributors. chris doyle was dead wrong claiming distributors could be "end users".

    In its complaint against Herbalife, the FTC also charged that the multi-level marketing company’s compensation structure was unfair because it rewards distributors for recruiting others to join and purchase products in order to advance in the marketing program, rather than in response to actual retail demand for the product, causing substantial economic injury to many of its distributors.

    “This settlement will require Herbalife to fundamentally restructure its business so that participants are rewarded for what they sell, not how many people they recruit,” FTC Chairwoman Ramirez said. “Herbalife is going to have to start operating legitimately, making only truthful claims about how much money its members are likely to make, and it will have to compensate consumers for the losses they have suffered as a result of what we charge are unfair and deceptive practices.”
    The small minority of distributors who do make a lot of money, according to the complaint, are compensated for recruiting new distributors, regardless of whether those recruits can sell the products they are encouraged to buy from Herbalife.

    Finding themselves unable to make money, the FTC’s complaint alleges, Herbalife distributors abandon Herbalife in large numbers. The majority of them stop ordering products within their first year, and nearly half of the entire Herbalife distributor base quits in any given year.

    It will be interesting to watch Herbalife sales die once the injunctions are enforced.

    MLM.com says the same, no longer can you sign everyone up as a distributor, and then "they decide" whether or not to sell. This is HUGE! MLM will be forced to profeed with majority retail to non-distributor customers, or face the same fate as VEMMA and Herbalife.

    It's about time that they took the pyramid out of MLM. The whole house of cards is about to come crumbling down...

    Wow, I should've read the whole thing, where VEMMA had the 51% customer mandats, Herbalife has a whopping TWO THIRDS RETAIL RULE!!!

    Stick a fork in them, they're done!!!

    Herbalife were already doing this as most people join for a discount, not to build a business. All it requires is a name change from ''distributor'' to ''preferred customer''.

    Herbalife "said" people were joining for a discount. It was based on a biased survey that Herbalife commissioned and did not disclose the details. The FTC found that far fewer people were actually joining just to buy the products cheaper. That's why they Vemma'd Herbalife, but raised the bar on retail sales to 2/3.

    In the settlement, Herbalife waived their right to appeal any of the injunctions. Herbalife, at least in the US, appears to be toast once the injunctions are enforced. Herbalife is probably counting on sales in other countries to keep them alive, unless the other countries follow the US lead and impose similar restrictions.

    Basically, the FTC found Herbalie to be a pyramid scheme without actually labeling them as such.
