What a load of slop. This is really embaressing; exactly the kind of stuff that gives the MLM industry a bad name.

Not only that but I can't believe that Ambit actually let's its reps solicit outside programs to the field. My guess is they won't, as they seem to be less tolerant about abuses since they recently terminated one of their top earners.

That's interesting because on Page 8 of Ambit's Policies and Procedures it states-

4.3 Bonus Buying Prohibited

How stupid are you to admit in public that you are participating in this terminatable offense. Ambit cannot ignore this manipulation of their compensation plan. My understanding from people in the know at Ambit is they are cracking down on abuses like this at every level (including recently terminating a top 10 money earner for similar activity). At the very least your little customer mill will be shut down soon. And since you have no idea how grass-roots networking works your future at Ambit will be dead. Don't you realize that every MLM lives off breakage and cannot exist with 95% payout?

Rather than just deceptively putting up only the Title of 4.3 of the Policies and Procedures, let's also include the paragraph itself. Here it is:

4.3 Bonus Buying Prohibited

Bonus buying is strictly and absolutely prohibited. "Bonus buying" includes: (a) the enrollment of individuals or entities without the knowledge of and/or execution of an Independent Consultant Application and Agreement by such individuals or entities; b) the fraudulent enrollment of an individual or entity as a Consultant or Customer; c) the enrollment or attempted enrollment of non-existent individuals or entities as Consultants or Customers ("phantoms"); d) Purchasing Ambit products or services on behalf of another Consultant of another Consultant or Customer, or under another Consultant's or Customer's ID number, to qualify for commissions or bonuses; and/or 3) any other mechanism or artifice to qualify for rank advancment, incentives, prizes, commissions or bonuses that is not driven by bona fide product or service purchases by end user consumers.

As I indicated in my post above, not only is our customer acquisition program completely within Ambit's policies and procedures, but in a recent major Texas regional meeting of top Ambit leaders, Jere Thompson and Chris held up our group's customer acquisition program PUBLICLY in that top leaders program as THE MODEL PROGRAM abiding by ALL Ambit Policies and Procedures. One of many things that separate our program from other programs floating around in Ambit is that we don't charge the downline for the placement of these customers (whereas many other groups do and Ambit frowns upon that practice although I don't think that is prohibited in the Ps and Ps).

Finally, regarding the 95% figure, some people around here, as they usually are, are confused. There is a major difference between a 95% trigger rate and a 95% payout.

Actually, the rest of the paragraph in no way changes the meaning of (d) and there is no other possible interpretation than you have admitted to Bonus Buying. It clearly says that Bonus Buying is when you purchase customers for other consultants to get paid. That is what you are doing.

Bonus Buying has nothing to do with the fact that the customers are legit. It has everything to do with the fact that you are obtaining customers from a third-party source and strategically placing them under other reps (otherwise known as stacking) to trigger money. This indeed goes against both the spirit of the plan (which is to teach reps how to get their own warm market customers and not find cold market customers for them) and obviously against the letter of Ignite policies.

Don't even try to say this is for the benefit of your reps. What you are doing is a rep churning system for your own gain. All can be assured that you will give them the two customers they need to release money to their sponsor and upline and then abondon them. The result is a disillusioned rep who doesn't know how to get their own customers. If this is how Ambit is building their customer base they are short for this world. To the contrary they are in the process of clamping down on violators.

Why don't you talk to Brian McClure about "loyal" customers.

Ok. Let's examine d) word for word. Here it is again:

In both cases what is required to violate this clause is the purchasing by the VIOLATING REP of Ambit products and services. That's why they call it BONUS BUYING. Who is doing the buying? The one who gets BONUSES. Who gets bonuses? Customers? NO! Customers don't get paid commission bonuses from Ambit! It's the REPS who get commission bonuses from Ambit! Thus it's the reps under this clause who are BUYING THE BONUSES...and...very importantly...BUYING THE BONUSES USING THEIR OWN MONEY/ACCOUNTS...if they are in violation...more on this below.

When we hire a property management firm as our sales agent to encourage and persuade their new move-ins (buying new and used houses in the neighborhood) to choose Ambit as their energy provider and then that customer pays for their Ambit products and services out of THEIR checking account, that has absolutely NOTHING to do with the 4.3 part of Ambit's policies and procedures that have been cited here.

Even if one doesn't understand the English language, and if one wants to reject my aide to your reading comprehension above about the second clause presuming that one is well versed enough to know that the verb and verb object of the first clause is automatically carried over to the second clause, there is STILL no possible even TWISTED reading of the following original version reproduced here again

d) Purchasing Ambit products or services or services on behalf of another Consultant or Customer, or under another Consultant's or Customer's ID number to qualify for comissions or bonuses;

that could, by any stretch of the imagination, have anything to do with bonafide customers buying Ambit products and services with their own money OUT OF THEIR OWN CHECKING ACCOUNT/PLASTIC on their own accord.

Because d) above even without my reading comprehension aide in italics above still clearly indicates that the purchasing of Ambit products or services is being done by THIS HYPOTHETICAL VIOLATING REP (the one violating d above) AND is ALSO clearly purchasing OUT OF THEIR OWN CHECKING ACCOUNT/PLASTIC the Ambit products or services in question here (regardless of whether it's purchased thru another rep's account or thru a customer's account the FUNDING SOURCE is the VIOLATING REP'S OWN CHECKING ACCOUNT OR PLASTIC).

And, of course, that's what BONUS BUYING means anyways in terms of a common sense rubber meets the road definition. It's where the

REP THEMSELF

is buying products/services from the MLM company thru rep and/or customer accounts other than their own in order to artificially inflate their product volume and/or recruiting statistics in order to QUALIFY for a bigger commission check and/or title.

Us hiring a property management agent to get bonafide customers for us that are paying for their electricity and/or natural gas bills via their own established Ambit energy account numbers OUT OF THEIR OWN CHECKING ACCOUNT/PLASTIC has as much to do with this BONUS BUYING CLAUSE as little green men and cheese on the moon.

And so I say again..anyone who wishes to do so, keep on teeing them up...I'll continue to knock them out of the park...as anyone with an IQ north of 100 could...so if anyone wishes to continue to look silly and uninformed publicly, that's your own right and I certainly won't deprive anyone of it.

That was the long refutation. The short refutation goes like this, quoting the pertinent sentence in the other writer's post:

You can no more legally do that than you can tell a business owner that he can't hire a sales representative.

If you could, then you could and would even HAVE to prohbit an Ambit rep from hiring his or her own son or daughter at $5 a pop to go out and get Ambit customers.

Because there's absolutely no difference between what we're doing with the property management firm at $20 a new customer than what the hypothetical Dad would be doing above at $5 a customer paid to his kids.

The fact that someone here

a) originally only cited the title of 4.3 and didn't supply the actual paragraph of 4.3; and

b) asserts only their own opinions using their own language without using any of the language of 4.3

is prima facie proof of this being their own personal brain fart having nothing to do with 4.3

Once again, the actual verbatim language of 4.3 says that bonus buying involves the BUYING, not of customers, but the BUYING of actual

AMBIT PRODUCTS AND SERVICES

such as the violating rep paying for the Ambit rep kit of a pseudo-recruited Ambit representative and/or the violating rep paying the actual Ambit electricity or natural gas bill of a pseudo-recruited Ambit customer (all for the purposes of artificially inflating one's recruiting and/or product volume statistics for purposes of boosting one's bonus check and/or title within the company).

In no place in 4.3 does it mention anything about stacking customers. The term stacking (nor anything that could even be construed to mean stacking) is not even used.

A violation of 4.3 has not occurred unless the violating representative has actually purchased

AMBIT PRODUCTS AND SERVICES.

We are purchasing the sales services of a property management agent who, then in turn, signs up customers for us.

These customers pay for ambit products and services out of their own pocket.

Under the terms of 4.3, therefore only THEY could be hit with a violation of 4.3.

But, ooops, they're not reps. Only reps can be hit with a violation of 4.3. And only if the reps have purchased Ambit products and services (kits for pseudo-reps or paying for the energy bills of pseudo-customers).

In conclusion, the plain, unambiguous and irrefutable language of 4.3 sets forth these requirements for a violation to have occurred:

* it must involve an Ambit rep
* it must involve an Ambit rep out of their own pocket buying Ambit products and services
* it must involve an Ambit rep buying Ambit products and services on behalf of or thru the account of another rep where such rep has been pseudo-recruited (really isn't a bonafide rep intending to pursue the business) and/or it must involve an Ambit rep buying Ambit products and services on behalf of or thru the account of a customer where such customer has been pseudo-obtained (really doesn't want the Ambit energy products and services) ALL for the express intent and purpose of artifically inflating said violating rep's recruiting and/or product volume statistics so that said violating rep's bonus check and/or title in Ambit is similarly artificially boosted.

The most simple one sentence analysis that what we're doing (paying the property management company to obtain bonafide Ambit energy customers on our behalf) is the fact that the money being transferred here is being paid

TO THE PROPERTY MANAGEMENT COMPANY

and not to

AMBIT

because 4.3 clearly says that for a violation of 4.3 to have occurred that AMBIT products and services must be purchased and for Ambit products and services to be purchased

AMBIT

itself must be paid out of the pocket of the violating rep and we're simply not paying Ambit for anything here.

We're paying the property management company.

It's their name on the check that's being written.

Not Ambit's.

You are an idiot. Ambit's one and only intention of this clause is to stop guys like you from placing customers under your downline to release $$$. This is artificial manipulation of the comp plan and it is not good for the company or the downline. Every legit MLM has this clause in their Policies to stop such activity.

False information.

Ambit's only intention of 4.3, as has been abundantly proven using the plain language of the paragraph itself (which you refuse to do because you cannot given the language of the paragraph), is to prevent Ambit reps from buying distributor kits from Ambit while setting up what are essentially artificially recruited rep "positions" when, in fact, there isn't a real motivated human being wanting to really do Ambit behind the rep position; and to prevent Ambit reps from setting up Ambit customer accounts and then paying for the energy bills themselves (meaning that the "customers" really didn't want to be customers after all as proven by the fact that they aren't paying their own bills and letting an Ambit rep pay their bills).

That's what the TITLE of the clause itself means.

BONUS BUYING.

Key word: BUYING.

Buying what? Ambit products and services in order to enhance one's bonus.

We're not buying ANYTHING from Ambit as required under the 4.3 clause.

We're buying the SALES SERVICES of a property management company to obtain bonafide customers WHO PAY THEIR OWN AMBIT BILLS (not the reps).

Now, if you wish to "prove" your point, dig into the language of the paragraph and prove that 4.3 has anything to do with paying anyone to obtain bonafide customers who PAY THEIR OWN AMBIT BILLS.

We're not violating neither the letter nor the spirit of this clause. This clause has as much to do with what we're doing as it has to do with green cheese on Mars. Which is why Jere Thompson and Chris publicly praised our customer acquisition program as THE MODEL PROGRAM at a regional major regional LEADERS meeting in Texas.

As I said before, anyone who wishes to be intellectually disarmed, and publicly humiliated, step right up if this is the "best" you can do. :)

Constant Cash Collection is exactly correct. You, as a business owner of an energy distribution business, have the right to pay an agent to get your business, customers. Anyone in Ambit, and I am sure Ignite, can purchase customers from someone in position to get them. They may not pay a customer to be a customer, but they can pay an agent to get them. You keep preaching the purpose of mlm is to get "LOYAL" customers. I think the purpose of an energy business is to obviously get "LOYAL" customers, but to also get as many customers as possible. If one person has an edge over another, that is what separates top earners from average to non earners. Mr. Smith, once again you look like a retard.

I really can't say if your customer acquisition program is violating your company's P&P's or not - I guess if your corporate leadership is fine with it then I guess that answers that.

However, I would like to offer you a word of caution. I was in Excel for 6.5 years and there were a group of leaders that created a similar customer buying program. These reps were eventually kicked out of Excel because of this. Now, I don't they were kicked out because they were buying customers, they were kicked because of what they were doing with those customers. They were taking them and looking in their reorts for people who didn't have customers and they were placing them there for the sole purpose of releasing the upline bonuses. This was viewed as manipulation of the comp plan and was why they were booted.

Now, it's one thing if reps are buying customers for their own qualifications. It's a completely different story if you are buying customers and putting them under someone just to get your bonus. This is the classic definition of bonus buying in MLM - no different than buying product in a product MLM and placing it under someone - something that is against the rules in every MLM company.

I'd also like to suggest to you that what you guys are doing is the complete opposite of what Network Marketing is all about. It should be about someone gathering a group of LOYAL customers and then teaching others how to do the same. If you're buying a customer then there's no relationship. Where is the loyalty going to come from?

The reason Excel was so successful in creating a loyal customer base was because of the relationship. You guys are going to miss out on that completely and therefore are kissing your long term residuals goodbye, aren't you?

Also, you should be teaching your reps how to gather their own customers, you should never be giving customers away and putting them under people when they aren't involved in that process. How then are those reps going to learn how to gather customers - if someone else did it for them?

My point is, that if there is no real customer interaction then what you're building is nothing more than a house of cards. I'm not saying that its illegal (again if your company supports it then I guess they're okay with it) - I'm just offering you some advice, take it or leave it.

The hilarious thing here is that for someone with such a expertise in the English language (LOL) you seem to have missed the fact the Bonus Buying is referring to buying bonuses. How do you buy bonuses? By stacking customers under your downline instead of teaching them to enroll their own customers. (The fact that it also involves the "purchasing of Ambit products or services" is a different purchase.)

This is like trying to tell a blind man the sky is blue and he keeps insisting it is green. This is not a debatable issue; this language is common used in MLM policies for this exact reason. Do you really think Ambit wants to pay you for a shell downline that releases bonuses to you and doesn't build a team or lasting customer base? You are delusional.

If Ambit allows you to pay for customers then that is fine (most service based MLMs do not allow that however) but that is not the issue. The issue is paying for customers and stcking them to release bonuses upline. That will be the down fall of any MLM company and you are nothing more than an opportunist with no loyalty to your company if you engage in such.

Folks, if you don't have documentation, you don't have squat.

The one that keeps on insisting that 4.3 is talking about stacking customers, it's incumbent upon you to wade into the language of 4.3 and show how 4.3 has anything to do with stacking customers.

You can't do that. And so you don't do that. Point, ConstantCashCollection.

Re: the other fellow, this is what as known as anecdotal "evidence" (a close relative to hearsay, etc). In order to win any points here, you're going to have to document your claims (links to court cases if it ever went to litigation, etc).

The fact that 4.3 has nothing to do with an Ambit rep paying a 3rd party to obtain bonafide energy customers and placing them anywhere they wish has been proven here for all to see.

And if all that wasn't enough, this program was put together by one of the handful of founding NCs who is in daily contact with Jere Thompson and Chris.

PS Regarding one BM, initials only, I knew all about "that" long before anybody posted about it here and that's the reason why I didn't "go there." I'm known for doing my homework. :)

In Puerto Rico Ambit Energy is under the watchfull eye of the Office of the Comisioner of Financial Institution the equivalent of the federal SEC for promoting an investment scheme without the require licensing. This happend in the past with the illigal pyramid investement fraud Wealth Pools International.
Our sources tell us that the leader of Ambit pyramid scam in Puerto Rico Julio Rivera which scammed millions fron puertorican consumers in WPI will receive a citation by the comicioner office. Every day we receive inquires asking us our opinion of the Ambit scam and we have been succesfull on convincing those consumers no to become victims of a scam.

We will not rest until this scam is out of our shores.
